There are a number of state and federal laws that prohibit employment discrimination. The Americans With Disabilities Act likewise prohibits discrimination against qualified individuals with disabilities. Most workers in Pennsylvania are considered to be employees-at-will which means that the employer can discharge the employee for any reason so long as it is not an illegal reason such as discrimination. The key to proving discrimination is to present proof that the employer’s decision was actually motivated because of a protected trait (i.e., the employee’s race, sex, disability, age, etc.).
